Foreclosure and short-sale help in Orange County
Start with the dates.
If you are a homeowner facing foreclosure in Orange County and you need help fast, start with the dates on your notices, the payoff, and whether a sale can close before the trustee’s sale. I can list the house if that calendar allows showings, or I can bring all-cash offers when speed matters, and I am not your lawyer.
Bring the notices, the payoff, and the address. I am Joe Homs, designated broker of Pellego, California DRE #00702131, with 50+ years in Orange County, 600+ closed transactions, and 8 books. 348 people are licensed with Pellego. The office is at 23121 Verdugo Dr #100, Laguna Hills, CA 92653. I help you choose a sale path. I do not practice law, and I do not give tax advice.
What are the main options if foreclosure is already on the calendar?
Homeowners in Orange County usually have more than one door, and they are not equal. The right one depends on the dates in your file and on what the lender will sign.
| Loan workout | Forbearance, a repayment plan, or a modification is a conversation with the lender or a HUD-approved housing counselor. I do not negotiate the loan terms. |
|---|---|
| Reinstate | Paying the past-due amount plus the costs the notice allows can put the loan current. The window is on your paperwork. A common California marker is five business days before the sale. |
| List the house | If the trustee’s calendar leaves room for photos, showings, and escrow, I list it. The plan is on the sell-fast page. I will not promise a number of days. |
| Short sale | The lender must approve a sale for less than the debt, in writing. You may still owe the difference, and there can be tax. I can list it or bring offers for them to review. |
| Deed in lieu | Some lenders accept the deed instead of completing the foreclosure. That is the lender’s choice, and it is a legal and tax question for your advisors. |
| All-cash offers | When you need speed, I can bring all-cash offers. I do not buy every house. If a deal fits my criteria, that conversation is on the investors page. |
What do the notice dates usually mean in California?
Most California home loans foreclose through a trustee, without a court case. After a notice of default is recorded, a notice of trustee’s sale generally cannot be given until at least three months have passed. The sale date is generally at least 20 days after the notice of sale is recorded and published. You can often reinstate the loan by paying what is past due, plus the costs in the statute, until five business days before the sale. Those markers are in California Civil Code sections 2924 and 2924c. Your notice can name different dates, and some loans take a different path. Read the paper in your hand, and confirm it with the trustee or a California real estate attorney before you rely on a calendar I did not see.
A completed foreclosure can stay on a credit report for years. Bankruptcy is a separate legal choice. I will not tell you which one does less damage. That is a question for a lawyer who has your file.
How does a short sale work?
- We write down the payoff, the notice dates, and what you need from the move.
- I price the house from recent Orange County sales. The Real Number puts the payoff, the costs, and the next payment on one page.
- You, or your attorney, ask the lender in writing whether they will consider a short sale.
- If they will, I list the house or bring all-cash offers they can review. The listing plan is on sell my house fast in Orange County.
- The lender decides the price they will accept, any amount you still owe, and how long their approval lasts.
- You review that approval with a California real estate attorney and a tax advisor before you sign it. I will not sign it for you.
The Consumer Financial Protection Bureau housing page (opens in a new tab) explains short sales and other mortgage relief in plain language. To talk with someone about a loan workout, use your servicer or the HUD counselor search (opens in a new tab).
Can a sale happen fast enough?
Sometimes yes. Sometimes the sale date is too close for showings, a buyer’s loan, and a lender’s short-sale desk. I will say which one it is after I see the notices. When the calendar is short, I can bring all-cash offers. A cash buyer still has to clear title, and a short sale still needs the lender. I will not promise a closing date, a sale price, or that the trustee’s sale will be postponed.
How that cash path compares with a listing is on traditional agent or cash buyer. The full listing work is on the sellers page. If the next step is another house, start on the buyers page. If you are an investor looking at a foreclosure as a purchase, the numbers conversation is on the investors page and on investment property consulting.

Questions
What are the main options if I am facing foreclosure in Orange County?
Read the notice dates first. Then look at a workout with the lender, reinstating the loan, a short sale the lender approves in writing, a deed in lieu if the lender will accept it, a traditional listing if the calendar allows, or all-cash offers when speed matters. I can list the house or bring cash offers. I do not negotiate the loan, and I am not your lawyer or your tax advisor.
What happens after a notice of default in California?
Most California home loans use a nonjudicial trustee’s sale. A notice of trustee’s sale generally cannot go out until at least three months after the notice of default is recorded, and the sale date is generally at least 20 days after that notice of sale. You can often reinstate by paying the past-due amount plus costs, up to five business days before the sale. Those are the usual statutory markers. Your notices control. Confirm them with the trustee, your lender, or a California real estate attorney.
How does a short sale work for an Orange County homeowner?
A short sale is a sale for less than the debt, and it needs the lender’s written approval. You may still owe the unpaid difference unless that approval waives it, and forgiven debt can be taxable. I can price the house, list it, or bring all-cash offers for the lender to review. I do not approve the short sale. Ask a California real estate attorney and a tax advisor before you sign the lender’s terms.
Can you bring a cash offer before the trustee’s sale?
Yes, when you need speed I can bring all-cash offers. A cash offer can be easier to put in front of a lender on a short calendar because it does not depend on a new loan. I still will not promise a close date or a price. Title, the lender’s approval, and the trustee’s sale date all have to line up. I do not buy every house.
Will selling stop the foreclosure?
A completed sale before the trustee’s sale can be how the debt gets addressed, and a short sale or a reinstatement can change the file. I will not promise that a listing or a cash offer stops the sale. The trustee’s calendar and the lender’s written decision control that. Bring me the notices and I will tell you whether a sale can even be attempted in time.
Who do I call, and who gives legal advice?
Call me for the house, the comps, and the sale. Work (949) 625-4533. Direct cell (949) 394-0149. For the loan workout, use your lender or a HUD-approved housing counselor. For deficiency, credit, and tax, use a California real estate attorney and a tax advisor. My license is California DRE 00702131. I am the designated broker of Pellego.
